1. Agreement Overview

These Terms and Conditions ("Agreement") govern your use of Let's Mow Lawn's platform and services ("Service"). By booking lawn mowing services through our platform, you ("Client") agree to be bound by these terms.

2. Service Description and Standards

2.1 Standard Service Includes

  • Mowing of all accessible lawn areas to appropriate height
  • Edge trimming around borders, paths, and garden beds
  • Cleanup and removal of grass clippings (unless mulching requested)
  • Basic tidying of mowing areas

2.2 Service Quality Standards

We guarantee professional-quality lawn mowing services performed by experienced, insured contractors. If you're not satisfied with the service quality, we offer a satisfaction guarantee with re-service or refund options.

2.3 Additional Services

Services not included in standard mowing (such as fertilizing, weeding, pruning, or garden maintenance) may be available at additional cost and must be specifically requested and agreed upon.

3. Payment Terms and Pricing

3.1 Pricing Structure

Service pricing is based on property size, complexity, and frequency of service. Prices are clearly displayed before booking and include all standard services listed above.

3.2 Payment Processing

  • One-time services: Payment due upon service completion
  • Regular services: Automatic billing after each service
  • Payment methods: Credit card, debit card, or bank transfer
  • Failed payments: Service may be suspended until payment is resolved

3.3 Refunds and Disputes

If unsatisfied with service quality, contact us within 48 hours of service completion. We offer re-service at no charge or partial/full refunds based on the nature of the complaint.

4. Property Access and Client Responsibilities

4.1 Property Access

You are responsible for ensuring contractors can access your property, including:

  • Unlocked gates or providing access codes/keys
  • Clear pathways to lawn areas
  • Notification of any access restrictions or security measures

4.2 Property Preparation

Before each service, you must:

  • Remove or secure any obstacles (toys, furniture, hoses, etc.)
  • Secure pets safely away from mowing areas
  • Mark any sprinkler heads, cables, or hazards not easily visible
  • Ensure lawn areas are clear of debris that could damage equipment

4.3 Inaccessible Properties

If contractors cannot access your property due to locked gates, aggressive pets, or other barriers, a service fee may apply. You will be notified and given the opportunity to reschedule.

5. Scheduling, Cancellation, and Weather Policy

5.1 Service Scheduling

  • One-time services: Scheduled for specific date ranges
  • Regular services: Automatic scheduling based on your selected frequency
  • Timing: Services typically performed during business hours (8 AM - 6 PM)

5.2 Cancellation Policy

  • 24+ hours notice: Free cancellation or rescheduling
  • Less than 24 hours: 50% cancellation fee may apply
  • Same day cancellation: Full service fee may apply
  • Regular service cancellation: Can be paused or cancelled anytime with 24 hours notice

5.3 Weather Conditions

Services may be postponed due to:

  • Heavy rain or storms (safety concerns)
  • Extremely wet ground conditions (equipment damage/lawn damage risk)
  • Severe weather warnings

Weather-related cancellations are free and services will be rescheduled to the next available suitable day.

6. Liability, Insurance, and Property Damage

6.1 Contractor Insurance

All contractors carry public liability insurance (minimum NZ$2,000,000). This covers accidental property damage and personal injury claims arising from normal lawn mowing activities.

6.2 Property Damage

We are responsible for damage caused by:

  • Negligent use of equipment
  • Failure to follow proper mowing procedures
  • Damage to clearly visible property features

We are not responsible for damage to:

  • Hidden sprinkler systems, cables, or pipes not properly marked
  • Items left in mowing areas despite preparation requirements
  • Pre-existing property damage or wear
  • Damage caused by pets or inaccessible areas

6.3 Claim Procedures

Report any property damage immediately after discovery. Provide photos and detailed descriptions. We will investigate promptly and arrange repairs or compensation through our insurance as appropriate.

7. Communication and Platform Usage

7.1 Platform Communication

All service-related communication should occur through our platform messaging system. This ensures proper record-keeping and quality control.

7.2 Direct Contractor Contact

While contractors may provide contact information for day-of-service coordination, please avoid arranging additional services or payments outside the platform. This ensures proper insurance coverage and service guarantees.

7.3 Account Responsibilities

  • Keep account information current and accurate
  • Maintain secure login credentials
  • Report any unauthorized account access immediately
  • Use the platform respectfully and professionally

8. Privacy and Data Protection

8.1 Information Collection

We collect property addresses, contact information, and service preferences necessary to provide lawn mowing services. See our Privacy Policy for full details on data handling.

8.2 Information Sharing

Your information is shared only with assigned contractors and only to the extent necessary to provide services. We comply with the Privacy Act 2020 and other applicable data protection laws.

8.3 Property Security

All contractors are background-checked, but you remain responsible for securing valuable items and ensuring appropriate property access arrangements.

9. Quality Assurance and Complaints

9.1 Quality Monitoring

We regularly monitor service quality through client feedback, contractor performance reviews, and quality spot-checks.

9.2 Complaint Resolution

If unsatisfied with service:

  1. Contact us within 48 hours of service completion
  2. Provide specific details and photos if applicable
  3. We will investigate and respond within 24 hours
  4. Resolution may include re-service, partial refund, or full refund

9.3 Satisfaction Guarantee

We stand behind our work. If we cannot resolve your service concerns to your satisfaction, we offer a full refund for that service.

10. Seasonal Considerations

10.1 Growing Season Variations

  • Spring/Summer: More frequent mowing may be recommended
  • Fall: Final mows may include leaf cleanup where possible
  • Winter: Reduced frequency based on grass growth

10.2 Seasonal Service Adjustments

We may recommend schedule adjustments based on seasonal grass growth patterns. These recommendations help maintain optimal lawn health and appearance.

11. Limitation of Liability

11.1 Service Limitations

Our liability is limited to the cost of the specific service in question. We are not liable for indirect, consequential, or punitive damages.

11.2 Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including severe weather, natural disasters, or other force majeure events.

12. Dispute Resolution and Governing Law

12.1 Governing Law

This Agreement is governed by New Zealand law and subject to the jurisdiction of New Zealand courts.

12.2 Dispute Resolution

We encourage resolution through direct communication. If necessary, disputes may be resolved through mediation before pursuing legal action.

13. General Terms

13.1 Terms Updates

We may update these terms with reasonable notice. Continued use of our services constitutes acceptance of updated terms.

13.2 Severability

If any provision is found unenforceable, the remaining terms continue in full effect.

13.3 Entire Agreement

These terms, together with our Privacy Policy, constitute the complete agreement between you and Let's Mow Lawn.
